This privacy policy relates to your use of this App and Web Ordering Tool (the Drink & Dine platform) and describes how we collect and use personal information about you during and after your relationship with us, in accordance with the General Data Protection Regulation (GDPR).

This policy applies to all users (whether venues or customers of those venues) of the Drink and Dine App and our Web Ordering Tool.

The Drink and Dine platform is provided and operated by LWC Drinks Limited, a company incorporated in England (registered number 7677007) with registered office at Unit 3, Stainburn Road, Openshaw, Manchester M11 2DN (“we”, “us”, “our”) and we are the "data controller" (registration number: Z308690X).  This means that we are responsible for deciding how we hold and use personal information.

It is important that you read this policy, together with any other information we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information.

We comply with data protection law. This says that the personal information we hold about you must be:

HOW WE PROCESS YOUR PERSONAL INFORMATION

The kind of information we hold about you

  • Communications data (including emails, telephone calls and post which you receive from us or send to us, details of any feedback you give to us by phone, email, post or social media and your preferences in receiving information and being contacted by us).
  • Financial data (including payment card or account details which is restricted to payment and gateway providers).
  • Transaction data (including details about orders made by you, payments to and from you and other details of goods you have purchased from us and participating venues).

How is your personal information collected?

We collect personal information about you when using our Platform such as accessing the Platform, registering with us, contacting us via email, telephone, post or social media, when we contact you for or you send us feedback, make purchases via the Platform in participating venues (including communicating on updates to any order, replying to queries and resolve any problems), analysis of the Platform and complete customer surveys or participate in competitions via our Platform.

We may collect additional personal information in the course of trade-related activities throughout the period of you trading or otherwise dealing with us and our participating venues.

We collect this personal information from you either directly, such as when you register with us, contact us or purchase products or services via the Platform or indirectly, such as your browsing activity while on our Platform (see ‘Cookies’ below).

How we will use information about you

We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:

1.    Where we need to, to facilitate the orders you place through the Platform.

2.    Where we need to comply with a legal obligation.

3.    Where it is necessary for our legitimate interests or those of a participating venue and your interests and fundamental rights do not override those interests.

We may also use your personal information in the following situations, which are likely to be rare:

1. Where we need to protect your interests (or someone else's interests).

2. Where it is needed in the public interest or for official purposes.

Generally, we rely on your consent as a legal basis for processing your personal data for marketing purposes.  You have the right to refuse or withdraw consent to marketing communications at any time by contacting us.

The Platform is not intended for use by children and young adults under the age of 18, and we do not knowingly collect or use personal information relating to children.

Situations in which we will use your personal information

We need all the categories of information in the list above primarily to allow us to provide the Platform to you, to enable you to use the Platform for its intended purpose and to enable us to comply with legal obligations. In some cases we may use your personal information to pursue legitimate interests of our own or those of third parties, provided your interests and fundamental rights do not override those interests.

The situations in which we will process your personal information are listed below.

  • Registering you as a new customer and the on-going management of the account.
  • Providing ordering services at the participating venues you visit.
  • Technical support with the Platform.
  • Managing our relationship with you, responding to your queries and providing you with information about the Platform.
  • Processing payments through the payment providers of the participating venues.
  • Administration of competitions, promotions, surveys and events.
  • Prevention of crime and fraud.
  • Monitoring your use of our systems to ensure compliance with our IT policies.
  • Monitoring network and information security, including preventing unauthorised access to our computer and electronic communications systems and preventing malicious software distribution.
  • Data analytics studies to review and improve the Platform and customer experiences.

Some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personal information.

If you fail to provide Personal Information

If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into with you (such as your use of the Platform).

Change of purpose

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Data sharing

We may have to share your data with third parties, including third-party service providers and the participating venues.

We require third parties to respect the security of your data and to treat it in accordance with the law.

If you have given your consent to receiving promotional material from us and participating venues, then your data will be shared and used by us and participating venues for that purpose which may include sending you promotional offers and information about venues and special events.

Why might you share my personal information with third parties?

We will share your personal information with third parties where required by law, where it is necessary to administer the working relationship with you, or where we have another legitimate interest in doing so. For example, we will need to share your details with the participating venue when you place an order there.

 

HOW SECURE IS MY INFORMATION WITH THIRD PARTY SERVICE PROVIDERS AND PARTICIPATING VENUES?

All our third-party service providers and participating venues are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.

What about other third parties?

We may share your personal information with other third parties to facilitate the orders you place, to perform Service-related services or to assist us in analysing how our Service is used, to ensure our compliance with legal obligations and to protect our legitimate interests, which may include (without limitation) HM Revenue & Customs, accountants and auditors, lawyers and debt collection agencies. The types of third parties we may share your information with include:

·       Payment Processors

The Platform uses third-party services for payment processing (e.g. payment processors) and these are Global Pay and Optomony. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

·       Participating venues

This is to allow them to provide you with the goods and services you order, deliver an order to you and be made aware of any essential information you have provided such as allergy information or specific delivery information. You may consent to receiving marketing and promotional material. 

·       Delivery partners

The participating venues may use a third party delivery agent to deliver your order to you.

·       Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Platform. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network. You can opt-out of having made your activity on the Platform available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. Our Service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policy of every site you visit.

We may also share your personal information with other third parties in the context of the possible sale or restructuring of the business.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Data security

We have put in place measures to protect the security of your information. Details of these measures are available upon request.

Third parties will only process your personal information on our instructions and where they have agreed to treat the information confidentially and to keep it secure.

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

How long will you use my information for?

No fee usually required

Right to withdraw consent
